  1. You can not select guardians for any minor children
  2. The Public Guardian , |the Government," steps in and becomes involved in your children's personal lives. Wouldn't you want your children with people they know and trust?
  3. The Public Trustee becomes involved in the administering the children's share if they are minors. The Government will decide your children's financial future and of course take their fees from it.
  4. Your children may not receive the inheritance you want them to receive, and you can't provide a trust for them after the fact. Which is basically what happened to Michael Jackson's estate.
  5. If your children are minors when you die, this means that when they reach the age of majority the will receive the entire inheritance in one-lump sum instead of spread out over time

How to avoid the "B" word, Bankruptcy in 3 easy ways!


HOW TO AVOID BANKRUPTCY in 3 easy ways!

Missing payments and don't know how to pay the next one?
I listened to the 650 AM radio show with guests, Sands & Associates, last night. Great show! What we help clients do is to make it as easy as we can and make a plan that works for them.

There is a limit to how many times someone can go into bankruptcy in their lifetime! Did you know that?
3 x's and then not sure what your plan would be. 
But, why are you going into this problem again, did you not learn the first time?
Trying to pay back by paying one card with the other? It's time to do something!
That new business didn't work out? Now you are stuck with the business debt. Get some assistance in clearing this up.
  1. Either get another job, or a part-time income source that will allow to make those extra payments to decrease the debt. Pay off consistently and larger lump sums. Take one at a time to pay off one payment with the largest lump sums and then work on the other credit cards. Until you are back down to only having 2 credit cards only with ZERO balance! Yahoo!

So, many of our clients only have to go to step 2:
     
     2. Compile your list of debt and consolidate into one easy payment either incorporated into your mortgage or a separate loan. See a good Mortgage broker to get help with this. Links below.

3.  Go to your lawyer or a Trustee for assistance such as Sands & Associates, many various locations, to get help with a Consumer Proposal. Don't have a lawyer, we can help you with finding one across Canada and in the United States.

What is a Consumer Proposal?
A consumer proposal will allow you to settle your debts for a percentage less than you owe by making an agreement with your creditors. They had mentioned about 30% of the debt to make arrangements to pay back monthly over a 2 year,3 year, 4 year, or 5 year term maximum. Don't miss 3 or more payments with this agreement because it voids your agreement for the repayment. The Consumer proposal will only affect your credit report by an average of 9 months to 1 year with consecutive payments.
A bankruptcy #1 will affect your credit report by 1 yr to 2 years. They will say it's no concern from your history after the 5 year mark.

Extreme Events Are a Sign of What Is Yet To Come


What is coming next? As a Business owner how can I protect my wife and kids

A BUSINESS OWNER: 
Q. “A colleague of mine passed away suddenly and I had the opportunity to see first-hand the financial and emotional hardship he and his family are dealing with on an on-going basis because he had no plan for the unexpected events. How can I protect my wife and kids in case something happens to me? 
It is understandable that as the provider and protector of your family, you want to ensure that they financially and emotionally secure.  Have a succession plan for your business and leave your personal life in order.  Here are the top 10 tips to protect you, your spouse and family in case of any tragedy--
1-      Short term disability and long term disability policies will ensure that you have sufficient income to provide assistance to you and your family for living expenses, prescriptions, tests or treatments.
2-      A medical care policy that will care for you or a loved one in case of extreme disability, dementia, or sickness is very different than a disability policy. It will provide you with the medical attention, housing or care-aids when required.
3-      A power of attorney with delegation to a family member or trusted advisor will allow temporary decision-making on your behalf a simpler process.   
4-      A current last will and testament, a living will and a medical directive are all important so that your wishes are clear to family, healthcare providers and legal counsel.  If you don’t have these, do it now.
5-      Keep a current contact list for your lawyers, accountants, bankers, consultants, agents, advisors, managers, friends and associations. 
6-      Keep a copy of your birth and marriage certificates on file and easily accessible.  They may be needed when dealing with government agencies and when applying for transfer of benefits to your spouse.
7-      Consider life insurance that doesn't change in frequency, payment or benefit during your lifetime. That way it will be with you and your family forever without having to pay more, or lose it.
8-      Consider creating trusts for your family members. This can be a reliable income stream for family members without it being taxed as income.  Check with your accountant or financial planner on the current regulations.
9-      Organize personal bills and make notations for others that are left behind since so many bills are now e-statements.

10-   Keep a register (list and copies) of all of the aforementioned documents and information PLUS the registered owners of your personal assets such as your accounts, investments, property, safety deposit box, and vehicles in one place that is easy to find by your family.
